Texas Lawyer Practice Areas: Personal Injury

Texas Tort, Products Liability and Personal Injury practice:

Personal injury law covers damages that innocent people sustain as the result of the careless conduct and negligence of others. We help people recover compensation for their medical bills, lost wages, property damage and for the pain and suffering they are forced to endure as a result of the following negligent acts. In most cases, we do not charge a fee unless we collect on your behalf.  These cases tend to be fact specific. If you believe you have a issue, please call our office and discuss your case. There is no charge and no obligation for an initial consultation.

Also, we have an additional web site that contains frequently asked questions regarding personal injury matters: www.crookedinsurance.com

    •     Auto, Truck, Motorcycle & Pedestrian Accidents - If you are injured in a car accident that was not your fault, or was the result of a drunk driver, we can assist you with obtaining car repairs, rental vehicle, medical treatment and lost wages. In most cases, we do not charge a fee unless we are able to recover for you. In many cases, we can assist you with obtaining a rental car, and in getting your car repaired at no additional cost.

    •     Defective Products - If you are injured by a defective product, the manufacturer of the product, as well as the company that sold or installed the product may be liable.

    •     Slip and Fall Accidents - In many cases we are able to recover for medical bills and lost wages associated with slip and fall cases.

    •     Wrongful Death Cases - Wrongful death cases involve two types of claims: claims that the injured person suffered before death (called survivor claims) and claims held by the family (called the wrongful death statutory claimants). We can assist through both the probate issues (setting up a personal administrator for the estate of the deceased) as well as prosecuting the underlying personal injury case.

    •     Workplace Injuries - Call us about any injuries that happened on the job. If the company is a workman's comp subscriber, then we may be able to assist with getting the personal medical treatment or refer the person to someone who can assist with the worker's comp process. If a worker dies as the result of the gross negligence of the business, then we may be able to pursue the case and recover for the family.

    •     Daycare Abuse & Neglect - If you believe that your child was molested or physically abused at a day care center, call us immediately. We have successfully prosecuted daycare center abuse and sexual assault cases.

    •     Negligent Security and Failure to maintain a safe premises - Businesses have a duty to make their premises safe for people. This includes hiring adequate security appropriate for the type and location of the business. If you were injured by a criminal act of a third party while on a property, the business owner may be liable for failing to hire adequate security.

    •    Propane fires and explosions - Propane manufacturers and suppliers, according to the law, must take great care in the preparation and distribution of propane gas to the consuming public.  This care is necessary to prevent propane fires and explosions which are often catastrophic.  Propane gas explosions or fires can often lead to financially compensable injuries in a court of law.  Leon & Schulman, LLP, is committed to holding propane gas and tank manufacturers and suppliers responsible for the safety of the propane consuming public. Propane gas is odorless in its natural state; and therefore, manufacturers generally add ethyl mercaptan, a chemical odorant, as a means to provide the consumer with warning that propane gas is leaking. Unfortunately, ethyl mercaptan can be completely lost through a process called oxidation, which is a chemical reaction between rust or water in the tank and the ethyl mercaptan. Furthermore, ethyl mercaptan can be leached, or removed, from the gas if the propane escapes from its storage container and then passes through the ground. Propane fires and explosions often occur when a consumer using a propane-fueled appliance for cooking or heating fails to smell the leaking propane in his home, motor home, or outdoor patio and then unknowingly ignites the leaking gas.

Accordingly, many cases against propane manufacturers have involved this phenomenon known as "odorant loss." These cases are grounded in proof that propane manufacturers have been aware for some time that a certain combination of chemicals can provide the necessary odor for warning as well as provide resistance to odor loss from oxidation. As for the suppliers of propane gas, cases against these entities most often arise from the supplier's negligent failure to check the valves of all propane-burning appliances before refilling propane storage tanks. Propane fires and explosions can occur when there is a leak in the valve of a propane-fueled appliance and the leaking propane comes into contact with an open flame, which might be the pilot light for the hot water heater. Whether the injuries result from a defective tank, odorant loss, a supplier's negligence in refilling a storage tank, or a combination of the three, what is important to realize is that propane gas and tank manufacturers and suppliers are reluctant to admit liability for their conduct. Therefore, the preparation of these cases always requires sophisticated expert testimony. Through training and experience, our law office is qualified to select the appropriate expert chemical engineers and testing laboratories for each propane fire and/or explosion case. And while the law in Texas requires that a client be ultimately responsible for expenses, our law office advances or guarantees all expenses of litigation including court costs, expenses of investigation, and costs of obtaining and presenting expert witness evidence. Once your case has been decided, these costs are deducted from the total settlement collected.
